This is an uncomfortable subject but one that we must address.
Sex offenders in the workplace is not an easy topic.
What do you do if a potential new hire shows up on a sex offender registry?
Are you considering using sex offender information to make hiring decisions?
Consult a qualified attorney in the state in which you do business to learn more about the laws on hiring, or not hiring, sex offenders.
Without going into detail, Megan’s Law, came into existence after 7 year old, Megan Kanka, was raped and murdered.
The law requires convicted sex offenders to register with the state’s registry and allows the registration information to be recorded publicly online.
As a business owner with employees, it's important to know who you're hiring and what their background is.
However, you are prohibited from using certain information against the offender.
Do you own a business frequented by families or mothers with children?
What about your other employees who have children?
In some ways, the laws appear to give the offender more protective rights than those around them.
What's important is that you know what the laws are for your business in your state.
Know your rights, the offender's rights and those of your employees and customers.
Don't sweep it under the carpet and hope no one finds out.
It could have been a one off situation and the person has gone through rehab; it could also be a repeat offender.
Don't make assumptions.
Know your rights, and theirs.
